www.circus-records.co.uk is owned and operated by Circus Records Limited a company registered in England and Wales under Company Registration Number 07227691. The company's registered office address is at c/o Parkers, Corner Chambers, 590A Kingsbury Road, Birmingham B24 9ND, United Kingdom.

Registration and passwords

In order to purchase items via the website you will need to register your details to create an account, and provide information including your name, email address and billing and shipping addresses. You agree that the details provided by you on registration or at any time are correct, truthful and complete.

As part of the registration you will need to create a password for your account. You must keep your password confidential and must not disclose or share it with anyone. You are responsible for all activities including orders that take place on your account or are submitted under your password. You are also responsible for any access to your account or use of this website by you, or any other person using your password, whether or not such access has been authorised by you.

Privacy

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully, in accordance with the Data Protection Act 1998. When you purchase a product from Circus Records we collect and process your information to fulfil your order, and to register an account for you for future purchases and updates.

The type of information we will collect about you includes your name, email address, and billing and shipping addresses.

We use a third party payment processor, suppliers and couriers or shipping agents to ensure the payment, supply and delivery of your purchased products. These third parties have no authority to use your personal information for any promotional purposes.

This site may from time to time contain links to other websites. Circus Records takes no responsibility for the privacy policy or content of these other websites. We encourage you to read the privacy policy of each website you visit prior to disclosing your personal information.

Your email address may be used to register you to receive email updates if you opt to receive such communications from Circus Records. We will not email you in the future unless you have expressly given us your consent. We will give you the chance to refuse any marketing email from us in the future. Circus Records will never share your personal information with any third parties for their promotional purposes.

We may use technology to track the patterns of behaviour of visitors to our site. This can include using a 'cookie' which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.

To access, update, or change your personal information, you can log into your Circus Records account. Alternatively you can check the information that we hold about you at any time by emailing us at info@circus-records.co.uk and asking for details. If you find any inaccuracies we will either delete the information or correct it as required. Please note any demand for access may be subject to a fee of £10 which covers our costs in providing you with the data required.

Our services

Our website allows you to purchase physical products such as vinyl records, CDs, clothing and other items, and to access and download digital music.

You may purchase downloads and all other items for your personal and non-commercial use only.

The choice of products may vary from time to time. We may discontinue or alter any aspect of the website or services offered at any time without prior notice.

Goods supplied are not for resale.

The prices payable for items that you order are set out in our website. All prices are inclusive of any VAT payable at the current rates unless otherwise stated. We may change the prices for products at any time by posting new prices on the website, but any changes will not affect any orders that we have already confirmed have been despatched to you.

The price of an item may not include the delivery charge, which will vary according to the delivery method you select. Delivery charges applicable to your order will be calculated and displayed on screen prior to your payment details being taken. There are no delivery charges for downloads. If for any reason we have under priced an item, we will not be liable to supply that item to you at the stated price, as long as we notify you before we despatch the item to you. Instead we will notify you of the correct price so that you can decide whether you wish to order the item at the correct price. If you decide not to order the item we will give you a full refund on any amount already paid for that item, in accordance with our Refunds policy.

We make every effort to ensure the goods we supply are of satisfactory quality and reach you in original and good condition.

Clothing: to prolong the life and condition of clothing items we recommend that you turn garments inside out before machine washing, do not wash over 30º, and do not iron direct onto the printed area.

All goods are subject to availability and may be changed at any time. If your order cannot be fulfilled you will be offered an alternative or given a full refund.

Purchases

Goods are only available to order online via the Circus Records website, orders are not accepted by email or post.

When purchasing goods from our website for delivery outside the UK, it is your responsibility to ensure you observe and comply with all relevant regulations and legislation local to you, including obtaining all required customs, import or other permits. We accept no liability in respect of the export or import of the goods you purchase.

To make a purchase through our online store you first need to register your details, and you can then place an order.

All our payment transactions are processed by PayPal. You place your order on our site and proceed through the checkout where your order is encrypted and passed to PayPal to complete payment. PayPal accept payment by MasterCard, Visa, Visa Delta, Switch and Solo (and any other card agreed by them from time to time).

Circus Records does not hold your credit or debit card details as all card data is processed securely by PayPal. Once payment is complete you will be transferred back to our website to complete your order, where an alternative delivery address can be selected.

By submitting your order, you are offering to buy the goods, and allowing us to use your personal details for the purpose of supplying the goods to you, which may include passing your personal details to third party suppliers and couriers or shipping agents.

You will be charged for the goods you purchase at the time you place your order.

After you have confirmed your order you will not be able to amend it, instead please see our Cancellation policy.

We reserve the right to decline to supply an item to you for any reason prior to despatch of the items to you, for example if we have insufficient stock to meet your order, we do not deliver to your location or any of the items that you ordered were listed at an incorrect price. Where items are despatched separately, our acceptance of the order in respect of each item takes place when that item is despatched. If we decline to supply an item to you we will give you a full refund of the amount paid for that item in accordance with our Refunds policy.

Circus Records will send you an order confirmation to the email address you provide, which is your proof of purchase.

Promotional codes / discounts / offers

Where a promotion offers a percentage discount on a purchase, the cost of the qualifying purchases will be reduced by the discount percentage offered, provided you add the correct offer code to your order.

Delivery charges will not be discounted unless this is specifically stated in the offer.

Delivery

Our delivery charges, where applicable, are displayed as part of the order process. The delivery charge for your order will be calculated and displayed on screen prior to your payment details being taken.

You are responsible for payment of any import duties or taxes that may be payable for items ordered from our website for delivery outside the UK which will be levied once the goods reach their destination country or specific destination. We have no control of these charges and cannot advise what they may be. You are responsible for ensuring that you comply with all applicable laws and regulations for the country to which goods are to be delivered. We will not be liable for any breach of any such laws by you.

We will deliver the goods to the shipping address you specify in your order. It is your responsibility to ensure that this address is accurate.

You will become the owner of the goods you have ordered when they have been delivered to you.

Downloads: You will be sent an email confirming details of how to download your music. You can download each item up to five times, within a maximum of 5 days from when the first download is made.

Physical Products (CDs, Vinyl, Merchandise, Clothing etc.): We will normally despatch orders on the next working day but please allow 5-10 working days for delivery to the UK, and longer for delivery to other countries. Orders are shipped Monday-Friday (excluding UK bank holidays).

In the unlikely event that you do not receive your goods within 30 days of placing your order please notify as soon as possible so that we can resolve the issue.

Whilst we make every effort to deliver all your items within 30 days of the date of your order, we shall not be liable if we fail to do so either in part or in full due to circumstances which are beyond our control. In this situation we will be liable only to make good any shortage or non-delivery or to refund to you the amount paid by you for the goods in question.

A signature may be required at delivery. By placing an order you are authorising us to accept signature from another person on your behalf if you need to sign for an item and you are not present at the time of delivery.

Ownership of the goods passes to you as soon as the goods are delivered and/or signed for. If your order is returned to us undelivered due to circumstances beyond our control you will be held responsible for all re-shipping costs.

Cancellations

Downloads: We are not able to cancel your purchase once we begin the process of supplying your download.

Physical Products (CDs, Vinyl, Merchandise, Clothing etc.): To cancel, you must inform us in writing via email to orders@circus-records.co.uk. You must include your order reference, your name and address, and details of the item(s) you wish to cancel.

If the item(s) have not been despatched we will cancel the order and we will refund payment in accordance with our Refunds policy.

If the item(s) have been despatched to you and we are unable to stop the delivery, you can return the item to us in accordance with our Returns policy.

Returns

We hope that you will be happy with your purchase but should you wish to return or exchange an item you can return items to us within 14 days from the day on which you receive the product.

You have a legal obligation to take care of items while they are in your possession. If you fail to do so, we may have a claim against you for compensation. Items are your responsibility until they reach us.

The cost of returning the item to us is your responsibility. For your own protection we recommend that you send the goods using a delivery service that insures you for the value of the goods.

Where you are returning an item we will provide a refund of the cost of the goods within a maximum of 30 days from the date we receive notice of your return. Please see our Refunds policy for more information.

CDs, Vinyls etc.

• Prior to returning any items to us please contact us at orders@circus-records.co.uk, quoting your order number, details of the product and reason for return.
• We will advise you what to do and if we can accept the return.
• Please note that your right to return an item does not apply to audio and video recordings including CDs and vinyls where the product has been opened or unsealed as we cannot be sure in these circumstances that copies of the product have not been made.

Clothing

• Items must be returned to Circus Records c/o James Charles House, 37A Aylesbury Street, Bletchley, Milton Keynes MK2 2BQ.
• Please return the item(s) with the original packaging and the receipt.
• You must include your name and address, and confirm whether you would like a refund or exchange.
• If the items are faulty or damaged please state this as the reason for return, and enclose details of the cost to return the item to us.
• If you would like to exchange the item please advise the size and colour of the replacement required. No additional postage will be charged for exchanges.

Refunds

When you cancel or return goods we will provide a refund of the cost of the goods within a maximum of 30 days from the date we receive notice of your cancellation or return.

If goods are damaged or faulty we will refund the price of the item in full, including the cost of delivering the item to you and the cost of returning the item to us.

If you return goods for any other reason we will refund the price of the item in full, including the cost of delivering the item to you. However, you will be responsible for the cost of returning the item to us.

If we cancel your order prior to despatch for any reason we will give you a full refund of the amount paid for that item within a maximum of 30 days from the date of your order.

We will refund the delivery charge in full if you return all items of your order at the same time. If you choose to keep some of the items, we will retain the balance of the delivery charge that applies to the items you keep.

We will usually make any refund using the same method originally used by you to pay for your purchase. Our liability to you in connection with any order will not exceed the total price charged for the items. We shall not be liable for any indirect, consequential or special losses even if we have previously been advised of the likelihood of such losses.

Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price.

Complaints

Please email as at info@circus-records.co.uk and we will endeavour to provide an initial response within five working days. We will then work with you to resolve your complaint to your satisfaction as quickly as possible.

Your use of our website

We will use all reasonable endeavours to ensure that the website does not have any problems however we are not able to guarantee the availability of the website.

Access to the website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

The website is available to you only for promotion of the activities of Circus Records and its artists, and for the sale of related merchandise.

All material on this site is the sole and exclusive property of Circus Records or its affiliates. All rights, including copyright, in this website are owned by or licensed to Circus Records Ltd. Unless otherwise specified, this website including all content and services are for your personal and non-commercial use only.
